Protective Covenants
Homes:
- Building plans, site plan, and exterior colors shall be subject to review by HOA board prior to construction. Exterior colors shall be natural colors.
- Exterior lighting shall be downlights, or those type to preserve a dark sky.
Building setbacks for all structures shall be 75’ from roads and trails, including the trail around the flowage. 10’ from side lot line. - 50’ vegetative buffer to remain along all wetlands, community trails, and all roads, with the exception of one
- 20’ wide viewing corridor allowed per dwelling. We want to encourage owners to do a minimum of clearing around flowage.
- All home types are allowed except not trailer homes/mobile homes, or park model homes. Completion of exterior of buildings shall be completed within 12 months of construction start.
Lots & Land Usage:
6. No Subdivision of lots into less than 5 acre buildable parcels. Lots Zoned Forestry must remain in Forestry Zoning.
7. One Single family home per lot. Multiple homes or multi family buildings not allowed.
8. No tree or vegetation clearing between main trail and Mosquito Brook flowage, other than for HOA community access points or DNR approved work, to preserve shoreline.
9. Lot access to come off of development’s roads, not from highway or county property.
10. Area cleared for home/yard/pole barn/driveway is limited to no more than ½ acre cleared.
11. Pole barns shall be limited to 2400sf and 25’ in height, and shall be natural colors to blend with the forest.
12. Vehicles – no abandoned, unlicensed, inoperable, or junked vehicles, debris piles, or other unattractive items. No semi-truck parking or travel other than household deliveries.
13. No lot owner shall grant public access or easement to county property through their lots, as we want to avoid public ATV/snowmobile traffic through the development.
14. All trails are non-motorized, except for grooming and maintenance vehicles.
Lifestyle:
15. No burning of household garbage. Outdoor wood boilers must be clean burning.
16. Hunting is allowed on own property by bowhunting only. No firearm discharge. Bowhunting to be done at least 200’ away from any roads, trails, or homes. No hunting on Preserve community properties.
17. The Mosquito Brook Flowage is non-motorized use only; no hunting or harvesting is allowed.
18. No signage or displays to be posted on the roads or highways, other than normal realty-type sized signs.
19. Animals allowed are dogs, cats, and chickens. No roosters. No other farm animals.
20. Strict Noise ordinance. We have Quiet time of 9PM on weekdays and 11pm on Weekends.
Home Owners Association
- Dues shall start at $950/year per lot. This roughly divides into $500/yr for road maintenance and plowing, and $400/yr for trail maintenance and grooming, and $50/yr for common properties. Dues are due whether you have built a home or not. Dues begin 1/1/26.
- Dues shall be calculated by dividing the annual costs of the development by the number of lots, and will change in the future based on costs.
- Dues shall cover trail grooming and maintenance, and road maintenance, taxes on common properties (roads and parks), and any other uses as voted on by the members.
- Dues shall be paid in advance of the year. Dues are due by Jan 1st for the following year. HOA fee will be prorated for first year based on time of ownership.
- Board shall be a 5 person board. Chairman, 2 Officers, secretary, and treasurer, to 2 year terms. Board voting alternates every year with 2 or 3 positions open.
- One HOA vote is allocated per lot.
- Annual elections to be held the Saturday nearest the 4th of July, or as agreed by the HOA.
- All property owners agree to abide by all covenants.
Additional rules:
Noise ordinance – noise to be kept to a minimum. Quiet time is 9pm weeknights and 11pm on weekends.
- All private roads and private trails are accessible by all residents and guests of The Preserve.
- No commercial activity allowed, other than those specifically approved by the HOA.
- Dogs are allowed on ski trails, but only as long as they are not damaging the trail.
- We are a Dog Friendly Community. Dogs may be walked off-leash, but must be verbally in control, and reasonably behaved.
- Dogs that show aggressive behavior must be leashed.
- Renting your home is allowed, as long as the rental is not disruptive to neighbors.
- HOA to give permit to rentals.
- Three strikes you’re out. HOA will issue two written warnings for disruptive rental behavior, and the third offense will result in revocation of rental privileges and permit. Or whatever rule is allowed by law.
- All property owners shall be assessed the same fees for road and trail maintenance, regardless of location.
- HOA fees are due per 5 acre original lot. If you buy two lots, you pay 2X.
- 10MPH speed limit on roads for off-road vehicles.
- ATV’s allowed for residents and guests only, and must stay on roads.
- Trails are non-motorized
