The Preserve – Protective Covenants

Homes:

1. Building plans, site plan, and exterior colors shall be subject to review by HOA board prior to construction. Exterior colors shall be natural colors.
2. Exterior lighting shall be downlights, or those type to preserve a dark sky.
3. Building setbacks for all structures shall be 75’ from roads and trails, including the trail around the flowage. 10’ from side lot line.
4. 50’ vegetative buffer to remain along all wetlands, community trails, and all roads, with the exception of one 20’ wide viewing corridor allowed per dwelling. We want to encourage owners to do a minimum of clearing around flowage.
5. All home types are allowed except not trailer homes/mobile homes, or park model homes. Completion of exterior of buildings shall be completed within 12 months of construction start.

Lots and Land Useage:

6. No Subdivision of lots into less than 5 acre buildable parcels. Lots Zoned Forestry must remain in Forestry Zoning.
7. One Single family home per lot. Multiple homes or multi family buildings not allowed.
8. No tree or vegetation clearing between main trail and Mosquito Brook flowage, other than for HOA community access points or DNR approved work, to preserve shoreline.
9. Lot access to come off of development’s roads, not from highway or county property.
10. Area cleared for home/yard/pole barn/driveway is limited to no more than ½ acre cleared.
11. Pole barns shall be limited to 2400sf and 25’ in height, and shall be natural colors to blend with the forest.
12. Vehicles – no abandoned, unlicensed, inoperable, or junked vehicles, debris piles, or other unattractive items. No semi-truck parking or travel other than household deliveries.
13. No lot owner shall grant public access or easement to county property through their lots, as we want to avoid public ATV/snowmobile traffic through the development.
14. All trails are non-motorized, except for grooming and maintenance vehicles.

Lifestyle:

15. No burning of household garbage. Outdoor wood boilers must be clean burning.
16. Hunting is allowed on own property by bowhunting only. No firearm discharge. Bowhunting to be done at least 200’ away from any roads, trails, or homes. No hunting on Preserve community properties.
17. The Mosquito Brook Flowage is non-motorized use only; no hunting or harvesting is allowed.
18. No signage or displays to be posted on the roads or highways, other than normal realty-type sized signs.
19. Animals allowed are dogs, cats, and chickens. No roosters. No other farm animals.
20. Strict Noise ordinance. We have Quiet time of 9PM on weekdays and 11pm on Weekends.
